HC seeks govt reply on job advt

Allahabad: A division bench of Allahabad high court, comprising Justice S K Singh and Justice D K Arora, called upon the state as well as Central government to file their reply within three weeks in a writ petition, seeking quashing of an advertisement for the appointment of ayush chikitsak (male and female) as well as pharmacist. This order was passed on a writ petition filed by Aijaz Ahmad and nine others.
This writ petition was filed seeking quashing of an advertisement dated June 23, 2010, as well as all subsequent actions taken on its basis on the ground that the action initiated by means of the impugned advertisement is unreasonable, arbitrary, and does not spell clear terms and conditions of engagement on contract basis of ayush chikitsak and pharmacist.
The impugned advertisement also does not spell out number of the posts and distribution of posts among the degree holders of BAMS (bachelor in ayurvedic medicine and surgery), BUMS (bachelor of Unani medicine and surgery), BHMS (bachelor of homeopathic medicine and surgery) and reservation criteria has also not been fixed, the petitioner alleged.
S F A Naqvi, appearing on behalf of petitioner, pointed out to the bench that the advertisement is clear case of “spoils system”. The applicants were given little time to apply, which ultimately leaves out various prospective candidates, due to lack of communication.
It was also urged by Naqvi that if the reservation criteria would have been applied, in accordance with UP Public Services (Reservation for Schedule Castes, Schedule Tribes and Backward Classes) Act, 1994 (hereinafter referred to as Act No. 4 of 1994), with upto date amendments till 2005, the case would have been different and those petitioners would have been selected.
The constitutional law relating to reservation as well as publication of advertisement and offering post in general was to be strictly followed by the state authorities, so that no discrimination may take place. This aspect of the matter was totally ignored by issuing impugned advertisement.
